A federal judge has dismissed a defamation lawsuit against Fox News and Tucker Carlson related to the January 6th events. Judge Jennifer Hall stated that Carlson’s reporting on Ray Epps is protected by the First Amendment. She ruled that Epps’ lawyers did not demonstrate Carlson acted with "actual malice. " The judge granted Fox News’ motion to dismiss the case before it went to trial.
Media experts had previously speculated that Epps might succeed in proving Carlson's reports involved malice. Some commentators mentioned the recent high-profile defamation case against Fox News and anticipated potential repercussions for the network. However, Judge Hall sided with Fox's legal team, stating that Carlson's statements reflected opinions rather than false claims. The defense argued that Carlson provided viewers with interpretations that they could agree or disagree with based on available facts.
After the ruling, Fox News commentators acknowledged the distress Epps and his spouse had experienced, but emphasized that the matter had been a legitimate public discussion around the January 6th incident. Epps had sued Fox News in July 2023 following Carlson's suggestions that Epps may have been involved with the government during the Capitol breach.
Epps was seen in video footage urging Trump supporters to enter the Capitol. He later received a sentence of twelve months probation for his actions, which many believe was lenient compared to other individuals involved in the January 6th riot. Carlson also accused Epps of providing false testimony to the January 6th Committee.
Fox News expressed satisfaction with the court’s decision, highlighting its significance for press freedoms under the First Amendment.
