Jack Smith has transferred the classified documents case against Trump to the US Attorney's Office in Florida. He withdrew his appeal related to the case on December 30, 2024. Smith indicated that the Special Counsel's office referred the case to the United States Attorney for the Southern District of Florida, which is now involved.
Previously, Smith had asked a federal appeals court to put a stop to the classified documents case against Trump. This request follows another one to pause the January 6 case against Trump. In July, Smith had appealed a decision made by Judge Cannon, who dismissed the classified documents case, citing issues with the special counsel's appointment and funding.
In June 2023, Trump was indicted with 37 federal counts concerning the storage of presidential records at his Mar-a-Lago estate, which was under Secret Service protection. Trump faced 31 counts related to the Espionage Act for retaining national defense information and six additional process crimes connected to discussions with his lawyer.
Judge Cannon dismissed the entire case, instructing that it should be closed. The dismissal was based on claims of unconstitutional elements, including the appointment process by US Attorney Merrick Garland and the unlimited funding given to Smith without Congressional consent. While Smith had previously appealed Cannon's dismissal, he ultimately decided to pass the case to federal prosecutors.
