Let's Create 'First Amendment Zones' on Social Media
What's the solution? One path would be to create "First Amendment zones" on each site, where political speech would be treated identically to speech in the public square.
True, social media companies are private entities, while the First Amendment was written to restrict government action.
In Marsh, a 1946 case decided on a 5-3 vote in a decision written by First Amendment champion Hugo Black, the court found that free speech cannot be censored on the streets of a company town, even though the company owned and built those streets: "When we balance the constitutional rights of owners of property against those of the people to enjoy freedom of press and religion, as we must here, we remain mindful of the fact that the latter occupy a preferred position," Black wrote.
In Packingham, the court unanimously ruled that North Carolina could not restrict registered sex offenders from the use of social media such as Facebook, because such social media had become too central to First Amendment freedoms.
"The Court has always sought to protect the right in this spatial context. ... While in the past there may have been difficulty in identifying the most important places for the exchange of views, today the answer is clear. It is cyberspace - the 'vast democratic forums of the Internet' in general and social media in particular. Seven in ten American adults use at least one Internet social networking service. ... Facebook has 1.79 billion active users. This is about three times the population of North America."
Congress should therefore amend section 230 to create "First Amendment zones" on the giant social media sites where political speech is treated identically to the way that same speech would be treated in the actual public square.
Even under the First Amendment, there are still penalties for slander, libel, child pornography, disclosure of troop movements, criminal conspiracies, incitements to violence ... and these penalties would continue to exist for speech on social media just as they do for speech in the public square.

Twitter Capitulates: Reinstates NYPost Account After 16-Day Suspension
Following contentious Congressional testimony this week from Twitter CEO Jack Dorsey and a 22% drop on Friday, the social media giant finally decided to unlock the New York Post's account just days before the general election - after more than two weeks in Twitter jail for posting a negative article on the company's preferred candidate, Joe Biden.
In a Friday afternoon thread, Twitter Safety wrote that their policies are 'living documents' which they're willing to 'update and adjust when we encounter new scenarios or receive important feedback from the public.
"The company says they're 'updating our practice of not retroactively overturning prior enforcement," and have decided to let the Post have their account back.
The move also comes after DHS Acting Secretary Chad Wolf penned a scorching letter to Twitter demanding answers over why they've censored Customs and Border Protection senior official Mark Morgan over a post touting the southern border wall as helping to "Stop gang members, murderers, sexual predators, and drugs from entering our country." It appears his account is still locked, however.
The company was last able to post on October 14, the day they dropped a bombshell report regarding alleged incriminating contents on Hunter Biden's laptop.
Earlier today, Jake Tapper donned the Big Tech gimp suit, climbed out on a limb like a good little helper, and demanded New York Post sign the false confession demanded by Tapper's Big Tech dom.
The Post has gained nearly 200,000 new followers since being locked out.
US Seizes "Largest Ever" Haul Of Iranian Missiles & Oil: 'Enough For A Large Military Force'
On Thursday the United States revealed it had previously seized a major shipment of Iranian missiles bound for Yemen, and separately that it seized and later sold 1.1 million barrels of Iranian fuel bound for Venezuela.
The DOJ identified that it as top Iranian Revolutionary Guard Corps operatives behind the clandestine shipments of fuel and weapons.
The 1.1 barrels of fuel had been previously reported as seized by US authorities in August.
US courts have ordered Iran's clerical regime to pay damages over attacks, most recently in July when a judge told Tehran to pay $879.1 million over a 1996 bombing in Saudi Arabia that killed 19 US airmen.
Authorities also said the Navy had confiscated other weapons components and enough blasting caps to "Approximately" supply the U.S. military forces for a year, "Leading law enforcement to believe these blasting caps were intended for a large military force."
Days ahead of the US election, there's little doubt that Tehran is actively rooting for Joe Biden to take the White House, given Trump's maximum pressure campaign is crippling the Iranian economy and fast putting the two sides on a war footing, especially after the January assassination of IRGC Quds Force commander Qassem Soleimani.
Meanwhile Iran and Venezuela have pledged deepening cooperation, while the US has vowed to "Destroy" and missiles transferred to the Maduro regime.

Joe Biden is not out campaigning like a legitimate candidate. Neither is Kamala Harris. No presidential candidate since George Washington has done this. Why? You would think with Trump’s 30,000 person rallies he and the DNC would be concerned.
The answer: Huge amounts of dark money are flowing into his campaign, far more then even Obama’s campaign. This includes support from China.
Most importantly, The DNC is using social media and the mainstream media as its campaign vehicle. They have co-opted the mass media to do the campaigning for what is essentially a puppet candidate.
