Yesterday, April 27, there was a pre-trial hearing in the Michael Sussmann case relating to various evidentiary issues.
For the uninitiated, Sussmann a former Perkins Coie partner, and former attorney for the DNC/Clinton Campaign, has been charged by Special Counsel John Durham with providing false statements to then-FBI General Counsel James Baker in the fall of 2016.
The Special Counseltold the court that while Joffe and Sussmann pushed the Alfa Bank/Yotaphone hoax to the CIA in February 2017, this false information was also pushed "To another branch of government, to the legislative branch" at a later time.
The Special Counsel's statement reminds us of this letter we discussed from Rodney Joffe's attorney to the attorneys for Michael Sussmann, stating the Yota phone-related allegations percolated "Through various branches of the government and around the private sector after that date, in various forms."
Sussmann's lawyer informed the court that the Special Counsel stated on April 26 that Steele is "Out of the country and isn't likely to be a witness."
Steele is not cooperating with the Special Counsel.

Mayorkas testified before the House Judiciary Committee on Thursday.
Republican House Judiciary member Rep. Steube asked Mayorkas how many cases he has referred from the DHS to the DOJ for white supremacy or domestic terrorism.
"How many cases involving white supremacists and domestic terrorists have you referred to DOJ for prosecution?" Rep. Steube asked Mayorkas.
Mayorkas pushed back on the Congressman and refused to provide any data.
"Congressman, I will provide you with that information subsequent to this hearing," Mayorkas replied to Steube.
"I do not have that statistic. I will provide the data to you."
Congressman Steube proceeded to read data from the Department of Justice that reveals nearly half of all criminals prosecuted in federal courts were aliens.

A District of Columbia police officer used a large wooden stick to strike the body and head of protester Rosanne Boyland three times as she lay motionless on the ground on Jan. 6, 2021, according to bodycam footage from several officers obtained by The Epoch Times.
Police at the mouth of the Lower West Terrace tunnel at the U.S. Capitol ignored dozens of pleas to help Boyland after she collapsed, the videos show.
Police bodycam video shows protesters begging officers to render life-saving aid to Boyland from the moment she collapsed at the mouth of the tunnel.
A protester right at the police line who was bleeding from a baton strike to the head pointed to Boyland and pleaded for help.
As Coffee pushed the police line back, bystanders dragged Boyland down several steps and began CPR. Nearly three minutes later, they carried her directly in front of the police line and continued doing CPR. No officers moved to lend assistance.
Bodycam footage of Boyland being dragged from the tunnel entrance at 4:31 p.m. shows what appears to be a wound on her forehead. Another bodycam view seems to show a long red mark starting on the lower section of her left rib cage.
Hundreds of CDC Employees Haven't Received COVID-19 Vaccine
Nearly 400 employees at the U.S. Centers for Disease Control and Prevention haven't received a COVID-19 vaccine, according to data obtained exclusively by The Epoch Times.
A total of 382 workers at the CDC are unvaccinated, Roger Andoh, a Freedom of Information Act officer at the agency, told The Epoch Times.
Another nine employees have just had one dose of the Pfizer or Moderna vaccines, meaning they also don't qualify as fully vaccinated per the CDC's guidelines.
"The response I got to your appeal from CDC gave me the impression they didn't mean to withhold any information in the first place," Jonathan Nelson, a FOIA analyst with HHS, told The Epoch Times in an email.
In addition to revealing that 391 employees weren't fully vaccinated, the CDC said that 12,399 were fully vaccinated, meaning that they had received two doses of the Moderna or Pfizer vaccines or the single-shot Johnson & Johnson jab.
5,810 employees shared that they had received a booster dose, although the agency stressed that employees don't have to say whether they've had a booster.
The CDC also disclosed that the agency had granted zero requests for exemption to President Joe Biden's federal worker vaccine mandate, which is poised to take effect on May 31 after a months-long suspension due to a court ruling.

FBI warrantless searches of Americans' data more than doubled from 2020 to 2021, ODNI report
The FBI more than doubled the number of warrantless searches it conducted of Americans' communications data from 2020 to 2021, according to a report released by the Office of the Director of National Intelligence.
ODNI pointed out that this year's report is the first to track the FBI's use of "Unminimized Section 702 collection," which is raw data that the National Security Agency collects.
In a Friday press briefing on the report, a senior FBI official said that the 3.4 million figure "Is certainly a large number," the Wall Street Journal reported.
According to the report, tracking the precise number of Americans subject to the FBI surveillance is difficult because of how the bureau tracks its Section 702 data, which is different from other federal agencies.
"For reasons discussed more fully below, these statistics are reported separately from NSA, CIA, and NCTC due to unique variations in FBI's data, chief among them that FBI does not count the number of unique query terms, but instead counts the total number of queries, which could include duplicate queries of the same term," the report said.
Oregon Democrat Sen. Ron Wyden, a senior member of the Senate Intelligence Committee, said in a statement on Friday, "For anyone outside the U.S. government, the astronomical number of FBI searches of Americans' communications is either highly alarming or entirely meaningless."Somewhere in all that over-counting are real numbers of FBI searches, for content and for non-content - numbers that Congress and the American people need before Section 702 is reauthorized.
"The FBI must also be transparent about the particular circumstances in which it conducted a staggering 1.9 million additional queries in 2021. Finally, the public deserves to know whether the FBI has fully addressed the extensive abuses of its 702 search authorities that have been documented for years. Baseline transparency is essential if the federal government wants to hold such sweeping surveillance powers."

Sen. Raphael Warnock raked in thousands in campaign donations from the controversial CEO who called his employees "Dumb dolphins," just days after the businessman went viral for abruptly firing 900 employees over a pre-Christmas Zoom call.
Better.com CEO Vishal Garg gave a total of $8,700 to Warnock, including the maximum $2,900 donation to the senator's campaign committee on Dec. 31, according to campaign finance records.
Garg-who has been accused by investors of misappropriating millions and once berated his employees as a "Bunch of DUMB DOLPHINS"-made the donations to Warnock while he took a month-long leave of absence to deal with public backlash from the mass layoffs on Dec. 1.
The contributions from a man who has been dubbed the "Poster child for bad bosses" could undercut Warnock's attempt to portray himself as a champion of workers' rights and opponent of corporate greed.
Warnock has campaigned in support of "Equitable employment practices" and blamed inflation on "Greedy corporations" that are "Taking advantage of the pandemic's economic pressures to rake in unbelievable profits at the expense of Georgia families."
The Georgia Republican Party said Garg's donation shows that Warnock is "So desperate to hold on to power, no money is too dirty."
Warnock's campaign did not respond to a request for comment.

Unlikely Source Throws Cold Water on Climate Catastrophism
In New York Times Magazine it published an interview with Vaclav Smil, probably the world's greatest expert on energy-where it comes from, how we harness it, what it costs, and why it costs what it does.
The April 22 article "This Eminent Scientist Says Climate Activists Need to Get Real" is delightful to read. Author David Marchese squirms to escape the implications of everything Smil says.
He tries desperately to get Smil to agree that climate change is a looming catastrophe and we simply must act now to avert it by replacing fossil-fuel energy with wind, solar, and other "Renewable" sources.
Smil replies: "Germany, after nearly half a trillion dollars, in 20 years they went from getting 84 percent of their primary energy from fossil fuels to 76 percent. Can you tell me how you'd go from 76 percent fossil to zero by 2030, 2035? I'm sorry, the reality is what it is."
The interview continues, and again and again Smil brings Marchese back to reality-or at least he tries to.
Smil points out that developing countries all need to increase, not decrease, their use of fossil fuels to build their infrastructures.
Marchese asks, "Is there an argument to be made that countries developing new infrastructure have incentives to orient themselves toward renewables?" He later adds, "No today. Maybe tomorrow." Smil replies, "Putting a photovoltaic panel on a roof is very easy. Developing a system around photovoltaics for the whole country - very difficult. No country in the world today runs itself on pure photovoltaics," and "Not tomorrow. Again, it's the scale."
