An influential Republican group is preparing for a potential legal fight should Democrats attempt to remove President Joe Biden from the top of the ticket.
The group has identified three swing states where they believe taking Biden off the Democratic ticket would not allow anyone else to replace him: Georgia, Nevada, and Wisconsin.
Wisconsin does not allow withdrawal from the ballot for any reason besides death, while Nevada prohibits changes to the ballot after a certain date or if a nominee dies or is adjudicated insane or mentally incompetent.
In Georgia, if Biden were to withdraw less than 60 days before the election, his name would remain on the ballot but no votes would be counted.
The memo from the Heritage Oversight Project warns that policymakers and the public should be prepared for the potential consequences of Biden not running for re-election in 2024.
Administration officials have pushed back on a clip of Biden appearing to wander off during a parachute demonstration.
