Missouri bill would ban CBDCs, make gold and silver legal tender

Efforts are ongoing in Missouri to block the potential use of central bank digital currencies (CBDCs). This year, multiple bills have been introduced aiming to prevent the digital currency, which is not currently available in the United States.

Republican Senator Rick Brattin pre-filed Senate Bill (SB) 194 on December 1. This bill would change state laws to stop public entities from accepting a CBDC or taking part in any CBDC testing. It would also change the definition of money in the state's Uniform Commercial Code (UCC) to exclude CBDCs. Additionally, the bill mandates that the state treasurer must keep at least 1% of state funds in gold and silver, exempting their sales or exchanges from state capital gains tax, and making gold and silver legal tender.

The bill states that gold and silver should be accepted as legal tender at their spot price plus market premium in Missouri, with any verification costs being the responsibility of the receiving entity.

There is a strong legislative push against CBDCs, with other bills, including SB 1352 and House Bill 2780, also aiming to prohibit them. While SB 826 aimed to address CBDCs specifically, it was not passed. Recent months have seen laws against CBDCs introduced in other states such as Louisiana and North Carolina, and at the national level, the US House of Representatives passed the CBDC Anti-Surveillance State Act on May 23.
