President Donald Trump has declared an invasion at the U. S. southern border and issued orders to stop physical entry and repel this invasion. With millions of illegal border crossings impacting Texas, Gov. Greg Abbott claimed that President Joe Biden had broken the federal government’s promise to protect states against invasion, as stated in the Constitution. In response, the Biden administration sought to block Texas's border security actions.
Republican governors maintained that states have the right to protect their borders. Florida Gov. Ron DeSantis argued that if the Constitution meant that states could not defend against invasion, it would never have been ratified. Trump supports this view, stating that states agreed to forfeit some sovereignty in exchange for federal protection against invasion.
In his proclamation from January 20, 2025, Trump asserted that the southern border situation shows that the federal government has failed in its duty to protect the states. He declared an ongoing invasion and stated that the federal government must act to fulfill its obligations.
Trump's proclamation notes the importance of territorial boundaries and the authority to decide who may cross them. It cites how the Biden administration failed to enforce immigration laws, allowing many illegal entries that threaten public health and safety.
The proclamation states that the President has the constitutional authority to suspend entry into the U. S. when it is deemed detrimental to national interests, especially in times of emergency like an invasion. It grants the president power to control borders and remove those involved in the invasion.
The order suspends entry into the U. S. as of January 20, asserting that the presence of those engaged in the invasion is harmful. It emphasizes the failure to conduct necessary health screenings and background checks for individuals entering the country.
The declaration specifies Trump's actions are backed by the Constitution, including provisions for controlling foreign affairs and protecting against invasion. It instructs Homeland Security, the State Department, and the Attorney General to take necessary actions against any individuals participating in the invasion until it is deemed to have ended.
