President Joe Biden's attempt to gain a measure of control over the record number of illegal immigrants continuing to pour across the southern border suffered a legal setback on Tuesday.
A federal judge has blocked a controversial policy that gives Dept.
The surprise order came in response to Biden's push to end Title 42, which has led to a surge in border crossings - the approximate number exceeds 100,000 monthly.
The American Civil Liberties Union led in suing the Biden administration for what they viewed as a reversal of open border policies.
The Washington Post reported that Judge Jon Tigar of the U.S. District Court for the Northern District of California agreed and placed a 14-day hold on the new policy - giving the Biden administration a brief window to appeal before becoming a permanent injunction.
"The decision recognizes that everyone who arrives at our border has a legal right to apply for protection and is an important reminder that the administration needs to do more to ensure a fair and humane asylum system," said Cody Wofsy, an attorney with the ACLU's Immigrants' Rights Project.
Conservatives argue that President Joe Biden's border policies facilitate human trafficking, drug running, homelessness and a spike in crime and urge border policy reform.
