Texas House, Illinois state senator sue 33 AWOL Democrats in Illinois court

The Texas House of Representatives has taken legal action against 33 House Democrats who left the state for Illinois to avoid voting on Congressional redistricting. This lawsuit seeks to hold the absconding Democrats in contempt and to facilitate their return to Texas for their legislative duties.

• The lawsuit is filed in the Eighth Judicial Circuit Court in Illinois by the Texas Office of Attorney General and Illinois state Sen. Jil Walker Tracy.

• Texas House Speaker Dustin Burrows emphasized the need for all House members to fulfill their constitutional responsibilities instead of fleeing.

• Since the issuance of civil arrest warrants for 56 Democrats, only eight have returned to Texas, while 33 remain in Illinois.

• The lawsuit claims that the Democrats are intentionally disrupting Texas's legislative process and attempting to evade lawful civil arrest by staying out of the state.

• The Texas Constitution allows for the issuance of arrest warrants if members fail to provide sufficient excuses for their absence.

• The Democrats are opposed to a measure that could shift five Congressional seats from Democratic to Republican control in upcoming elections.

• The lawsuit cites Illinois Attorney General Kwame Raoul's assertion that law enforcement must have a valid basis to make arrests.

• Texas argues that it is entitled to have its legislative process restored and requires Illinois to honor its Quorum Warrants as though they were issued by Illinois itself.

• The lawsuit requests the Illinois court to compel the return of the absent Democrats and to initiate contempt proceedings against them for evading their obligations.

The Texas House's lawsuit against the Democrats aims to address their absence and restore the legislative quorum needed to discuss critical issues during a special session. Texas is seeking legal aid from Illinois to enforce its warrants and ensure legislative responsibilities are met.
