Federal immigration officials no longer will view unlawful entry into the country as the sole basis for detaining and deporting illegal immigrants, under a new Biden administration policy.
The policy will limit deportation to what immigraion officials call aggravated felons, such as violent gang members and others who commit violent crimes.
Critics of the new policy as stated by Homeland Security Secretary Alejandro Mayorkas note that it will allow those who commit domestic violence, drunk drivers, and others convicted of crimes to stay in America-amid an ongoing border crisis.
Wolf said the Trump administration prioritized criminal illegal immigrants over noncriminal illegal immigrants, but did so without exempting large swaths of people from law enforcement action.
Mayorkas issued a Sept. 30 memo that says, in part: "The fact an individual is a removable noncitizen therefore should not alone be the basis of an enforcement action against them."
The new guidelines will force ICE and Border Patrol agents to take into account multiple considerations besides unlawful entry before detaining illegal immigrants, said Art Arthur, a former federal immigration judge.
"The guidelines mean three things. First, the Biden administration is violating most of the Immigration and Naturalization Act," Arthur said.
