Ex-CIA official tied to anti-Trump intel claimed that Durham charged her. He never did.

Susan Miller, a former top CIA counterintelligence official under John Brennan, has repeatedly claimed that former Attorney General William Barr and Special Counsel John Durham criminally charged her and put her “on trial” for her role in the 2016 Russian election meddling assessment. However, no evidence supports her claims: no public records, no indictments, and no mention in Durham’s actual prosecution history.

Miller, who has attacked Donald Trump and his supporters in strong terms, appears to conflate her experience being interviewed by Durham’s team with an actual prosecution. She has repeated this story across podcasts, LinkedIn posts, and media interviews, often framing herself as the victim of political persecution.

Her claims are contradicted by the timeline (Barr didn’t appoint Durham until 2019, while she insists the “trial” began in 2017), by court records (Durham charged only Clinesmith, Sussmann, and Danchenko — none related to Miller), and by her own shifting descriptions.

Miller has also admitted that some CIA officials wanted to reach a conclusion about Trump’s legitimacy as president after 2016, and that her team explored whether Russian interference could have swung the vote. She distances herself from authorship of the official Intelligence Community Assessment (ICA), saying her team only produced an internal CIA report that was shared with Brennan and Trump.

Her security clearance has since been revoked. She is represented by high-profile attorneys Kenneth Wainstein (who also represented Brennan) and Mark Zaid (who represented the Ukraine whistleblower).

Overall, Miller’s public statements raise questions about credibility, memory, and political bias. While she frames herself as a persecuted truth-teller, available evidence shows she was never criminally charged or put on trial.

  • Who she is:

    • Susan Miller — former CIA Assistant Director for Counterintelligence under John Brennan (2016).

    • Claims role in 2016 Russian election meddling assessment.

    • Strong public critic of Trump and MAGA movement.

  • Her claims:

    • Says Barr and Durham filed a “criminal complaint” against her.

    • Claims she and colleagues were “put on trial” for their Russia assessment work.

    • Insists she spent “eight hours on trial” and that her lawyer confirmed charges.

    • Has never produced any evidence of a criminal complaint or trial.

  • Reality check:

    • No public record of any charges, complaints, or trials against Miller.

    • Durham charged only three people (Clinesmith, Sussmann, Danchenko).

    • Barr wasn’t AG until 2019, yet Miller claims her “trial” began in 2017.

    • Likely conflated Durham interview/deposition with prosecution.

  • Connections:

    • Podcast hosts (Sipher, O’Shea) who supported her narrative also signed the “51 intelligence experts” letter dismissing the Hunter Biden laptop as Russian disinfo.

    • Miller represented by Kenneth Wainstein ($1,500/hour) and Mark Zaid.

  • Other controversies:

    • Security clearance revoked.

    • Defends CIA as “truth-tellers” but admits her team wanted to decide Trump’s legitimacy.

    • Initially tied to faulty ICA that included Steele Dossier annex; later tried to distance herself, claiming her team only wrote a CIA internal report.

    • Public statements about Russia’s influence remain speculative (“might be true,” “Trump could be a Russian asset”).

  • Credibility issues:

    • Repeatedly shifts timeline and details.

    • Contradicts known facts about Durham investigation.

    • Strong political bias against Trump clouds her objectivity.
