A recount court judge in Virginia denied a request from Democrat Shelly Simonds on Wednesday to go over its finding that the state's 94th District House race resulted in a tie.
The move means the race will still be decided by a random draw on Thursday.
The outcome will have a major impact on Virginia's House of Delegates.
If Shelly Simonds beats Del. David Yancey (R), the chamber will be tied 50-50 between Republicans and Democrats.
However, Republicans will keep there 51 seat majority if Yancey comes out on top.
The winner will be seated on Jan. 10.
