ESG Investing in “Democratic” Companies

Environmental, social, and governance (ESG) has been rightly criticized for driving the politicization of American business, and it is hard to think of a more politicized method of evaluating corporations than by their political contributions. This is exactly what the Democratic Large-Cap Core Fund (DEMZ) does. It is worth examining both for the specific companies in its investment portfolio, as well as for how it illustrates an important distinction with respect to ESG investing, even among those who are skeptical of the practice.

The Democratic Large-Cap Core Fund is an exchange-traded fund that invests only in companies that support the Democratic Party.

According to the fund, as of December 2020 approximately 200 of the 500 companies from the index met these criteria-itself an interesting data point-and the fund's portfolio was constructed from that group.

Billing itself as a way for "Democrats to invest" and to "Invest in Democrats," DEMZ promotes its holdings as being "Fossil-fuel free." It also claims that the companies in its portfolio support ESG priorities such as diversity, equity, and inclusion programs; pay their employees a "Living wage"; and pursue "Thoughtful policies on climate change and environmental impact." The fund singles out companies such as AT&T, ExxonMobil, and Lockheed Martin for supposedly being "Republican-supporting" and asserts that corporations run by executives who support Democratic politicians are inherently more profitable.

Several companies on the list are associated with prominent liberal megadonors who give in ways that would not have factored in to the DEMZ fund analysis.

The former CEO and chairman of Progressive-the late Peter B. Lewis-was one of the original funders behind the Democracy Alliance, which subsequently expanded to become one of the largest and most influential left-wing funding networks in the country.

The decision of three New York City pension funds to divest from oil and gas companies in 2021 is the subject of an ongoing lawsuit from plan beneficiaries.

So the bottom line is that while DEMZ might be a product of the ESG-driven rush to politicize American business-itself a significant societal problem-it does not automatically follow that the fund itself is contributing to that problem, provided that it is restricted to private self-directed investors who for whatever reason prefer their investments to be based upon political criteria.

Election Transparency, Accountability, and Inclusion Act Model Law – DailyClout and American Voters’ Alliance

SECTION 1 – Statement of Purpose:

The state seeks to ensure fair elections by treating all eligible voters and ballots equally, promoting transparency, accountability, and objectivity in election management. The legislature aims to restore faith in the election process, which has been diminished by alterations in process and law and the infusion of private monies and expertise into government management of the 2020 election.

SECTION 2: Definitions:

This section provides definitions for terms used throughout the act, including election management, core government function, ballot management, drop boxes, election machines, voter participation information, ballot harvesting, disability, cloud storage, micro-targeting, party observers, observation, in-kind services, and public record.

SECTION 3. Prohibition of Ballot Harvesting:

Ballot harvesting is prohibited, and absentee ballots must be delivered by the eligible voter, a properly designated person, the United States mail, or a common carrier to a staffed election office or designated receptacle at such office. Any ballot illegally harvested shall not be counted, unless authorized election officials can verify it.

SECTION 4. Voter Identification:

Voters are required to present a valid photo ID to vote. The following IDs are accepted: a driver's license, a current U.S. passport, tribal government identification, IDs issued by colleges, universities, or post-graduate technical or professional schools, a state non-driver's ID card, a U.S. military ID, or a valid state or U.S. government-issued ID.

SECTION 5. Citizen Observation, Transparency:

Election management and ballot management shall be transparent and open to observation by party observers. All contracts by election offices and officials retaining third parties to engage in core government functions, election management, or ballot handling shall be published and subject to state open records laws.

SECTION 6. Maintaining government objectivity:

No local, state, or county office or agency shall accept monies or in-kind assistance from any non-government source for election management or ballot management, unless authorized by the state legislature. Government offices shall not allow electronic access to voter registration records in a manner allowing access by non-government entities or agents for voter registration purposes.

SECTION 7. Absentee Balloting:

The preferred method of voting is in-person voting. Any qualified elector may request an absentee ballot if they expect to be out of the voting jurisdiction on Election Day or have a disability preventing them from voting in-person. Completed absentee ballots may only be returned by the elector, a person designated consistent with this act, a common carrier, an election official, the United States Postal Service, or a law enforcement officer in the official course of an investigation.

Section Eight. The Procedure for Voting by Absentee Ballot:

Return envelopes for absentee ballots must include an affidavit signed by the voter, which contains the signature of a witness or notary public. The oath must inform the elector that he or she is affirming under penalty of law that he or she is a United States citizen, is a qualified elector, and that the information provided is true and accurate. Absentee ballots that are returned but do not comply with this subsection shall not be counted.

Section Nine. Counting the Vote:

The counting of any ballot shall not commence until after the polls close on election day. Upon commencing the counting of ballots, the counting shall continue without interruption until completed.

Section Ten. Violations of this Act, Penalties, and Remedies:

The knowing violation of any provision of this Act by a government official shall be a class A misdemeanor unless otherwise indicated. Knowing violations of this Act in order to benefit a specific candidate, political party, or campaign shall be a class felony. The statute of limitations for violations of this Act shall be 3 years.

Section Eleven. Legislative Standing Committee – formation, powers, and responsibilities:

The legislature shall have standing to intervene as a party in any litigation wherein any other state agency is a party and the action relates to government management of elections. No state agency may settle litigation in a manner which alters the application of any provisions of the election code or this Act without the approval of the legislature when the legislature intervenes or is a party to the litigation.

Section Twelve. Legislative Standing:

The legislature shall have standing to intervene as a party in any litigation wherein any other state agency is a party and the action relates to government management of elections.

'Disturbing' Collusion Between Biden White House And Trump Prosecutors

As Smith prepares for trial in Washington and southern Florida, defense attorneys have uncovered a stunning trove of evidence that contradict claims that the Biden White House had nothing to do with the unprecedented federal prosecution of a former president and Biden's GOP rival in the 2024 general election.

In a text sent to a colleague on February 28, 2022, William Bosanko, NARA's chief operating officer, said "The 15 boxes from mar-a-lago had consummed all of our discussions" with the White House.

While the Biden regime worked behind-the-scenes to initiate the classified documents case-after all, Biden appointee Merrick Garland personally approved the unprecedented FBI raid of Mar-a-Lago, a decision that involved other political appointees-White House officials at the same time were collaborating with Willis' ongoing investigation into the 2020 election.

Records show Nathan Wade, Willis' alleged lover retained by her office and paid at least $640,000 for his work on the Trump prosecution team, met with Biden White House officials twice in 2022, including the same day Garland announced the special counsel appointment.

If Cannon permits the unsealing of most of the exhibits the defense filed, the Biden White House will have another major crisis on its hands.

The filing claims Nathan Wade, the special prosecutor hired to go after Trump, paid for luxury vacations he took with Fani Willis to Napa Valley and a cruise in the Caribbean - and used money from Fulton County to pay for their out-of-town escapades.

Part Two: Can Wind & Solar Energy Expand 50-100 Times?

Against the backdrop of current global energy production by fuel type, and as quantified in Part One, against a goal of increasing total energy production from 600 exajoules in 2022 to at least 1,000 exajoules by 2050, where does COP 28's goals put the world's energy economy? How much will production of renewable energy have to increase?

When measuring how much the base of renewables installed so far will contribute to the target of 1,000 exajoules of energy production per year in order to realize-best-case scenario-800 exajoules of energy services, the data reported in the Statistical Review of Global Energy is profoundly misleading.

If we're setting a goal of 1,000 exajoules of ultimate world energy production and assuming 80 percent of that 1,000 exajoules of energy input shall be realized as end-user energy services, then we have to examine how much usable energy wind, solar, hydro, and nuclear are actually being generated today.

Even if those other non-thermal sources of energy were to increase two to three times, without coal, oil, and gas, a stupefying expansion of wind and solar would be required.

Confronted with these facts, even the most enthusiastic proponents of wind and solar energy may hesitate when considering the magnitude of the task.

The uptick in mining, the land consumed, the expansion of transmission lines, the necessity for a staggering quantity of electricity storage assets to balance these intermittent sources, the vulnerability of wind and solar farms to weather events including deep freezes, tornadoes, and hail, and the stupefying task of doing it all over again every 20-30 years as the wind turbines, photovoltaic panels, and storage batteries reach the end of their useful lives-all of this suggests procuring 90+ percent of global energy from wind and solar energy is a fool's errand.

If coal, oil, and gas are phased out and it is unrealistic to expect nearly 1,000 exajoules of power to be delivered by wind and solar-generated electricity, what's left? Part three of this series will examine the potential of the remaining energy alternatives-nuclear, hydroelectric, biofuel, geothermal-along with possible innovations that someday may change the rules.

A Curious Correlation -Sunspots Vs. Major Hurricane Frequency

Question: During solar maximum, is solar UV light the primary catalyst for cloud condensation and responsible for the progress of the observed cloud modulation? Svensmark says that the cosmic radiation intensity at solar maximum is at the minimum thus producing less tropospheric aerosols and haze.

These aerosols can also act as cloud condensation nuclei which facilitate cloud formation.

White methane clouds predominate during solar maximum and disappear during solar minimum.

Texas Denies Federal Agents Access To Border Park At The Heart Of Razor Wire Standoff

Texas has rejected the federal government's request for access to a border park at the center of one of the ongoing disputes between the states and the Biden administration over immigration enforcement while the union representing the U.S. Border Patrol has said agents will not be pitted against state agents working to secure America's southern border.

Fox News reported that after the U.S. Supreme Court's 5-4 ruling last week allowing federal border-patrol agents to cut down razor wire erected by the state around Shelby Park, an area near the Rio Grande River that sees heavy illegal alien traffic, the U.S. Department of Homeland Security requested in writing that it be given access to the park, with a response demanded by Friday.

Texas Republican Attorney General Ken Paxton responded first by telling Fox News the state has no plans to comply, then with a letter formally rejecting the demand, citing the assessment that the federal government's latest letter "Abandons earlier factual assertions, asserts new ones, and supplies even less of a legal basis," the Western Journal reported.

"As I said before, this office will continue to defend Texas's efforts to protect its southern border against every effort by the Biden Administration to undermine the State's constitutional right of self-defense," Paxton told DHS attorney Jonathan Meyer.

The Journal added that the National Border Patrol Council, the official union of U.S. Border Patrol Agents, weighed in January 26 with a statement that federal and state border agents "Work together and respect each other's jobs," and the former were not about to start arresting the latter for following lawful orders.

"Lawful orders, no matter how unpopular or distasteful amongst rank-and-file agents, must be followed. Unlawful orders will not be followed," the NBPC said.

"Rank-and-file BP agents appreciate and respect what TX has been doing to defend their state in the midst of this catastrophe that the Biden Admin has unleashed on America."

FBI Confirm J6 Pipe Bomber Is A Biden Admin Official

The operative who planted pipe bombs near the Washington DC RNC headquarters the night before January 6, 2021, is a Biden government official, according to a bombshell admission by the FBI. Three years ago, on January 5, 2021, a person planted pipe bombs the night before the J6 protests.

The FBI continued to drip out new videos of the suspect who placed two pipe bombs at the DNC and RNC the night before the Capitol riot in the months following the incident.

In 2023 the FBI finally offered a $500,000 reward for information on the alleged bomber.

In May 2023 Representatives Jim Jordan, Andy Biggs, and Bill Posey sent a letter to the Federal Bureau of Investigation, demanding an update on the case of the J6 pipe bomber.

The committee's interest in the investigation was sparked by a whistleblower disclosure from a senior FBI official, which raised questions about the "Unusual" nature of the FBI's investigative efforts.

Now, there are reports that the operative who planted the bomb is a former government official - but the FBI refused to interview the person!

A former FBI agent said that the Bureau quickly believed that it tied the person who planted pipe bombs at the Democrat National Committee and the Republican National Committee to a particular Metro fare card and license plate, but did not allow him to interview the person of interest and pulled his team off of the lead. The allegation raises more questions about the pipe bombs, which were by far the most violent aspect of the January 6 protests, but which Democrats and authorities have seldom mentioned since.

U.S. Ranchers Band Together, Raise $300M To Save Our Food Supply!

Look, I don't need to convince you our food supply is under attack, in more ways than one.

According to the information provided, it appears that US ranchers are indeed taking steps to raise $300 million to build their own beef processing plants.

In recent years, there has been growing concern among ranchers about the control and pricing power of the "Big Four" meatpacking companies.

In response, some ranchers have decided to band together and invest in their own processing plants to have more control over the supply chain and potentially increase their profits.

Sustainable Beef LLC, a company organized by ranchers in Nebraska, is planning to build a $300 million beef processing plant near North Platte.

The US Department of Agriculture is also taking steps to encourage a more diverse supply chain in the beef industry, allocating $650 million to fund the construction of mid-size and small meat and poultry plants, along with $100 million in loan guarantees.

Overall, it seems that US ranchers are indeed making a concerted effort to raise $300 million to build their own beef processing plants.

New Mexico had a 660% increase in congenital syphilis, for the second highest rate in the country for both syphilis and congenital syphilis, with 76 cases in 2022.

California is in sixth place where congenital syphilis cases rose 1,500% with 528 cases reported in 2019.

Who knows why the massive outbreak in congenital syphilis cases was clustered around border states during the same period when a mass migration of illegal aliens was underway.

None of the billions we spend on the CDC, the NIH and all the other acronym public health bureaucracies could explain why congenital syphilis in the Northeast only amounted to 121 cases in 2021, 296 cases in the Midwest, but 939 cases in the West and 1,499 cases in the South.

Why does Alabama have 37 cases while Arizona had 181 cases in 2021? What does Arizona have that Alabama lacks? Clearly, Alabama is funding public health just the right amount while Arizona is underfunding it.

House Panel Approves Impeachment Articles Against Mayorkas

 A Republican-led House panel approved articles of impeachment against Homeland Security Secretary Alejandro Mayorkas on Tuesday for having "Willfully and systematically" flouted federal immigration laws and breached the public trust.

The House Homeland Security Committee voted 18-15 along party lines for the two articles of impeachment, affirming that Mayorkas failed to detain migrants crossing the border before deciding whether to grant asylum.

The marathon hearing, which dragged on for more than 15 hours, saw several procedural attempts by Democrats to tank the impeachment effort, with Republicans insisting that their year-long investigation had uncovered sufficient evidence that Mayorkas violated his oath of office.

House Speaker Mike Johnson pledged on Friday to hold a floor vote on the articles "As soon as possible" after having released a memo earlier this month citing 64 times the Biden administration undermined US border security.

In a letter hours before the hearing, Mayorkas denounced Green's committee for making "Politically motivated accusations and personal attacks" against him, while agreeing that the US immigration system was "Broken."

Mayorkas and Democratic panel members said the Biden administration merely differed with House Republicans on immigration policy - and both urged the passage of a bipartisan Senate bill with border enforcement provisions.

"The sham impeachment of Secretary Mayorkas is a baseless political stunt by extreme MAGA Republicans," Thompson said in his opening statement, before attacking the chairman and panel member who introduced the resolution.

Six Pro-Life Activists Found Guilty, Face 11 Years in Prison for Peaceful Protest

Six pro-life activists were found guilty on Tuesday for "Conspiracy against rights" and violating the Freedom of Access to Clinic Entrances in relation to a peaceful protest outside of a Tennessee abortion facility in 2021.

President Joe Biden's pro-abortion administration announced in October 2022 that it had charged 11 activists involved in the March 5, 2021, "Blockade" of the Carafem Health Center Clinic in Mount Juliet.

Attorneys for the activists said they were conducting a "Rescue" and had gathered on the second floor of the office building where the clinic is located to pray, sing hymns, and urge women not to go through with abortions.

Six of the activists have now been found guilty of a misdemeanor FACE Act charge, as well as a felony conspiracy against rights charge, which carries with it the possibility of up to 11 years in prison and fines up to $250,000.

Since the Supreme Court's Dobbs decision, the DOJ has notably charged more pro-life activists under the FACE Act than pro-abortion activists, despite the fact that FBI director Christopher Wray admitted in November of 2022 that approximately 70 percent of abortion-related threats of violence in the United States since the Dobbs decision have been against pro-life groups.

In December of 2022, Associate Attorney General Vanita Gupta also admitted in remarks at the Justice Department's Civil Rights Division's 65th Anniversary that the end of Roe v. Wade dialed up "The urgency" of the DOJ's work, including the "Enforcement of the FACE Act, to ensure continued lawful access to reproductive services." The Biden administration's pursuit of pro-life activists has resulted in several high-profile cases, including that of Catholic father of seven Mark Houck, who was found not guilty of federal assault charges brought by President Joe Biden's DOJ. The DOJ had decided to press charges against Houck, even though local authorities declined to press charges.

In response to these incidents, Rep. Chip Roy introduced legislation in September of 2023 to repeal the FACE Act, which "Prohibits threats of force, obstruction and property damage intended to interfere with reproductive health care services." Utah Gov. Cox Signs Transgender Bathroom Bill And Diversity, Equity And Inclusion Program End

  Utah Gov. Spencer Cox signed a pair of the 2024 Legislature's most controversial bills Tuesday night, just two weeks into the session.

Cox had signaled support for the bill - without directly promising to sign it - saying soon before the session began that he's concerned with protecting "Women's spaces" while treating LGBTQ people "With dignity."

"There is more work to be done. And it's up to all of us, and all of the people in our communities as we move forward, to treat each other with kindness and reach out to people in our communities and lift them up," bill sponsor Rep. Katy Hall, R-South Ogden, said in a hearing on the bill last week ahead of its passage.

Cox said in his statement the bill "Offers a balanced solution" to concerns about diversity, equity and inclusion programs.

Critics of the bill worry students of color and others who have traditionally benefited from diversity, equity and inclusion initiatives could lose out.

Former 4th Congressional District candidate Darlene McDonald - who runs nonprofit 1 Utah Project - pointed to the Utah Compact on Racial Equity, Diversity and Inclusion signed by then-Gov. Gary Herbert and Cox, who was lieutenant governor at the time, in December 2020.

"The compact represented a 'first step' toward addressing systemic racism by recognizing it as a structural issue, not an individual one. Tonight, just a little more than three years later, Utah joined a number of conservative red states to ban diversity, equity and inclusion programs from institutions of higher learning as well as political subdivisions," she said in the prepared statement on behalf of the 1 Utah Project.

This bill gets rid of all electronics.  It calls for 1 day of voting (state holiday) with paper poll books and paper ballots, eliminates early voting and absentee for 65 and over to limit mail in votes. It also establishes strong chain of custody, secure ballots measures as well as videotaping of the counting process. UPS Announces 12,000 Job Cuts Due To Drop In Package Volume

The United Parcel Service on Tuesday announced 12,000 job cuts after reporting a decline in the volume of packages being shipped, coming months after the company came to an agreement with a top union to pay drivers higher wages.

"In 2023, dynamic external and economic conditions led to lower volume and a more than $9 billion decline in revenue year over year," UPS Director of Financial and Strategy Communications Brian Hughes told USA Today, confirming the figure.

The job cuts will save the firm about $1 billion, the company's CEO, Carole Tome, told reporters on an earnings call.

In July, UPS agreed to a contract with the Teamsters worth about $30 billion to up full-time workers' pay to $49 per hour and $21 per hour for part-time employees.

UPS expects average daily volume to be weak in the first half of the year before recovering in the latter half.

UPS reported quarterly revenue of $24.9 billion, which is down from $27 billion year-over-year.

Amazon accounted for 11.8 percent of UPS revenue last year.

Massive Fire Engulfs Feather Crest Farm Chicken Plant in Texas, Reportedly Following Large Explosion

A massive fire has engulfed Feather Crest Farms, located east of Kurten, Texas, in Brazos County, causing widespread alarm and prompting a massive response from multiple fire departments.

The fire, which was reported just after 5 p.m. near Fickey Road east of Kurten, has become a major concern for local authorities and residents.

Muliti-state coalition sides with Texas in border battle against Biden

A coalition of state attorneys general sent a letter Monday to Department of Homeland Security Secretary Alejandro Mayorkas backing Texas in its border battle with the Biden administration.

Texas Gov. Greg Abbott defied the Biden administration last week, making clear he would continue to put up concertina wire fencing at the southern border to help stop the flow of illegal immigration, which has soared since Biden took office.

Abbott said after the ruling that the federal government had broken its pact with the states for not stopping what more than 50 Texas counties have declared an "Invasion." That court case is the latest touchpoint for the ongoing immigration crisis and frustration of many border states and Republicans who argue Biden is willfully aiding millions of illegal immigrants get into the U.S. "Since the Biden Administration has failed to do its job and secure the border, states like Texas have stepped up to protect their citizens," the letter said.

"A federal district court found that Texas's border defense wires reduced illegal border crossings by more than two-thirds. Those barriers protect not just Texans from millions of illegal border crossings, but the rest of the nation." More than 10 million illegal immigrants have entered the U.S. since Biden took office, more than the population of about 40 U.S. states.

The Biden administration has blamed Republicans, saying they have not passed the needed funding to secure the border.

"The invasion on our southern border has made every state a border state," Bird said in a statement.

"While the Biden Administration has opened the door wide for drug cartels, traffickers, and potential terrorists to cross our border, States have been left to fend for themselves. Ukrainian Defence Officials Charged With Stealing $40 Million From Weapons Budget

 Employees from a Ukrainian arms firm conspired with defense ministry officials to embezzle almost $40 million earmarked to buy 100,000 mortar shells for the war with Russia, Ukraine's security service reported.

The investigation comes as Kyiv attempts to clamp down on corruption in a bid to speed up its membership in the European Union and NATO. Officials from both blocs have demanded widespread anti-graft reforms before Kyiv can join them.

Ukrainian President Volodymyr Zelenskyy was elected on an anti-corruption platform in 2019, long before Russia's full-scale invasion of Ukraine in February 2022.

Security officials say that the current investigation dates back to August 2022, when officials signed a contract for artillery shells worth 1.5 billion hryvnias with arms firm Lviv Arsenal.

Company employees were supposed to transfer the funds to a business registered abroad, which would then deliver the ammunition to Ukraine.

The goods were never delivered and the money was instead sent to various accounts in Ukraine and the Balkans, investigators said.

Ukraine's prosecutor general says that the funds have since been seized and will be returned to the country's defense budget.

Terrorist Caught Illegally Crossing The Border Was Allowed To Roam Free For Nearly A Year, Memo Says

 Federal authorities caught a terrorist at the U.S. southern border and released him into the country, where he roamed freely for nearly a year before being arrested in Minnesota just days ago, according to an internal federal memo exclusively obtained by the Daily Caller News Foundation.

The unnamed individual, who the memo only identifies as a member of the Somali terror group al-Shabaab, was released shortly after being caught illegally crossing the southern border near San Ysidro, California on March 13, 2023, according to the memo, which the DCNF is not publishing in order to protect the identity of a confidential source.

Border Patrol caught 172 terror watchlist suspects attempting to enter the U.S. illegally during fiscal year 2023.

"Many within the Biden administration, including Secretary Mayorkas, have repeatedly assured us that the vetting process at the border is comprehensive and complete," John Fabbricatore, a retired ICE field director who now sits on the National Immigration Center for Enforcement's board, told the DCNF. "However, we continue to witness alarming instances where terrorists are able to freely roam the United States for months after being released at the border before their criminal and terrorist histories come to light."

The number of suspected terrorists caught trying to illegally cross the southern border continues to grow.

"The overburdening of the Border Patrol with the excessive amounts of illegal border crossers has forced faster processing times, which doesn't allow for a more vigorous initial investigation into a migrants background. The background checks currently being run only initially search out criminal history in the United States, not outside its borders. It could take days, weeks, or months to connect derogatory information coming from other databases," Fabbricatore said.

After Hamas' attack on Israeli civilians on Oct. 7, federal authorities warned Border Patrol to be on alert for Hamas, Palestinian Islamic Jihad and Hezbollah terrorists attempting to illegally cross the southern border, according to an internal memo exclusively obtained by the DCNF at the time.

Constitutionally Speaking, Texas Is Legally Allowed To Wage War Against The Federal Government To Protect Itself From Imminent, Open-Border Invasions

Constitutionally speaking, Texas is legally allowed to wage war against the federal government to protect itself from imminent, open-border invasions.

In a move that shocked many, the typically conservative-leaning Supreme Court has sided with the Biden regime in allowing federal agents to dismantle razor wire that Texas put up along a stretch of the U.S.-Mexico border near Eagle Pass.

Concerning the pending lawsuit, the argument being made contends that Article I, Section 10, Clause 3 of the United States Constitution supports Gov. Abbott's position that Texas has a right to defend itself against the ongoing border invasion.

In essence, the argument contends that Texas is both being invaded and is in imminent danger if nothing is done about it.

If the courts end up agreeing, things could change again as Texas asserts its constitutional authority to protect its own borders, even if D.C. disagrees.

"The first question for applying this clause to the case of Texas and the crisis at the border with Mexico is: Is Texas being invaded? If not, then the inquiry turns to: Has the influx of undocumented adult males into Texas risen to the level that a reasonable person would consider the danger so imminent as to preclude any delay, such as that of recurring to Congress for help?".

In other words, even if it cannot be successfully argued that Texas is currently being "Invaded," as the term would have been understood and intended by the founders, it could still be argued that Texas is in imminent danger from an invasion, allowing it to override the feds on how to protect itself.
