Chicago Now Seeing Deadly Consequences Of Its "Defund The Police" Policy

Expect Immigration Fireworks As SCOTUS Heads Into Its Final Month

 There's a certain irony in the fact that the lives of the citizens of a democratic republic can be drastically altered by the decisions of nine largely Ivy-League educated lawyers in Washington, D.C. Supreme Court decisions are now a fact of life so expect fireworks in the next month as the Court issues its final decisions before it recesses for the summer - including in Texas v. U.S., which will likely answer many of the questions surrounding the president's authority to not enforce the immigration laws.

The Pekoske memo limited DHS's civil immigration enforcement priorities to three groups: spies and terrorists; aliens who entered illegally on or after the arbitrary date of November 1, 2020; and incarcerated aliens convicted of "Aggravated felonies", but only the ones "Determined to pose a threat to public safety".

The restrictions in that memo limited immigration officers' ability not only to remove aliens who were not a priority, but even to stop and question them.

First, section 236(c) of the Immigration and Nationality Act requires ICE officers to detain and hold any alien who is released from criminal custody if the alien is seeking admission or entered illegally and is removable on any of the criminal grounds of inadmissibility, or if the alien entered legally and is removable on all but one of the criminal deportation grounds.

After an exhaustive analysis of those provisions, Judge Tipton concluded that the word "Shall" found in each "Means 'must,' imposing on the Government a duty to detain certain criminal aliens and those with final orders of removal when released and during the removal period, respectively."

On September 15, a three-judge panel of the Fifth Circuit issued a decision limiting the scope of that order, applying it only to two groups of aliens: criminals released from criminal confinement for whom ICE has issued a detainer, and aliens under final orders of removal.

While not as restrictive in its scope as the prior two Biden administration memos, the Mayorkas memo requires immigration authorities to consider so-called "Aggravating" and "Mitigating" factors that "Militate" in favor of or against the taking of enforcement action against facially removable aliens.

DATA: Voters Support Govt Shutdown Until Spending is Cut.

 A majority of Americans – 54 percent – would prefer a partial government shutdown until federal spending reduces than avoiding a shutdown by authorizing higher levels of government spending, according to a recent survey by Rasmussen Reports.

The majority comprised more than a third of Democrats – 36 percent – and almost two-thirds of Republicans – 74 percent.

A total of 57 percent of Democrats and only 17 percent of Republicans would prefer increased spending would prefer more spending.

Responsibility for the Federal Deficit Budget.

Rasmussen Reports also asked the 1038 likely U.S. voters: “Which is more to blame for the size of the federal budget deficit? Either “taxpayers’ unwillingness to pay more in taxes” or “politicians’ unwillingness to reduce government spending.”

The overwhelming majority of Americans – 68 percent – believe politicians are to blame, including a whopping 88 percent of Republicans and 47 percent of Democrats.

Only 40 percent of Democrats believed that an unwillingness to pay taxes was the primary reason for the size of the budget deficit.

Delay in Debt-Ceiling Increase.

Lastly, Rasmussen posed the question: “How likely is it that delay in passing a debt-ceiling increase will lead to the United States defaulting on its debt payments?”

A majority of 57 percent believed it was either “very likely” or “somewhat likely,” with 67 percent of Democrats and 45 percent of Republicans.

House Rules Committee Votes 7-6 to Advance McCarthy-Biden Debt Ceiling Bill

 The House Rules Committee on Tuesday voted to advance the McCarthy-Biden Fiscal Responsibility Act.

The 9-majority and 4-minority committee voted 7-6 to advance the bill with Reps. Chip Roy and Ralph Norman voting against the measure, Fox News Congress reporter Chad Pergram reported.

The full House of Representatives will voted on the bill Wednesday night.

House Freedom Caucus Chairman Scott Perry on Tuesday left open the possibility of filing a motion to vacate and get rid of McCarthy if the Speaker pushes through the debt deal.

Under new House rules, it only takes one member of Congress, from either party, to bring a ‘motion to vacate’ which forces a vote on removing the Speaker of the House.

It would only take a simple majority vote to remove McCarthy.

So far 7 Republicans are a “no” vote on the Biden-McCarthy debt bill.

Debt Deal Clears First Hurdle But Faces Uncertainty In Hands Of Full House, Senate

 The House Rules Committee on Wednesday night approved a measure to temporarily suspend the federal debt limit and impose discretionary spending caps and set up a final House vote - though the future of the package remains uncertain in the lower chamber - then a vote in the Senate.

The measure voted on Tuesday night follows months of negotiations between House Speaker Kevin McCarthy and President that conclude Saturday with a deal in principle.

Senate Majority Leader said prior to the vote his chamber would hold its vote as soon as possible, if and when it clears the House.

In late April, the GOP-led House passed the Limit, Save, Grow Act of 2023 which would have increased the debt limit by $1.5 trillion for one year and capped the growth rate of domestic spending.

Senate Democrats and the White House derided the plan as a nonstarter and the final agreement includes greater concessions to that faction.

McCarthy secured the Speaker's gavel after 15 rounds of voting, in large part by making concessions to the Caucus on the debt.

Cruz, in particular, took except to a comment House Minority Leader Hakeem Jeffries, who argued the plan includes "Not one thing" for Democrats.

U.S. Tax Court Judge David Gustafson has already once before denied an IRS request to dismiss the whistleblower case, first brought in 2017.

Gustafson postponed ruling on those motions, instead asking for new arguments in light of three recent precedent-setting court rulings, once again frustrating IRS efforts to make the case go away.

Monday's ruling adds new intrigue in a case that first surfaced nearly five years ago when Doyle and Moynihan, two respected forensic financial investigators, revealed the existence of their 2017 IRS whistleblower complaint against the foundation during a congressional hearing.

The foundation should've registered under FARA. Ultimately, the foundation and its auditors conceded in formal submissions that it did operate as a agent, therefore the foundation is not entitled to its 501c3 tax-exempt privileges as outlined in IRS 1702.".

In October 2020, Gustafson first allowed the whistleblower case to proceed, rejecting an IRS motion for summary judgement.

Months later, the judge suggested the IRS whistleblower office may have evidence it had not disclosed to the court in the case.

FBI Director Christopher Wray Will Be Held In Contempt Of Congress After Failing To Comply With House Republicans

 On Tuesday afternoon, Rep. James Comer, the chairman of the House Oversight Committee, announced that the FBI refused to apply with his subpoena and thus he will be holding FBI Director Christopher Wray in contempt of Congress.

Chairman Comer is demanding that the FBI hand over a document that a whistleblower alleges documents President Biden's bribery scheme.

"Today, the FBI informed that it will not provide the unclassified documents subpoenaed by the Committee," Comer announced in a tweet.

"The Committee will now be taking steps to hold FBI Director Wray in contempt of Congress for refusing to comply with a lawful subpoena."

DeSantis Spox Splits With Ron, Endorses Debt Deal.

 Governor Ron DeSantis’s “Never Back Down PAC” spokesman Steve Cortes has split with the newly minted presidential candidate over the McCarthy-Biden debt deal looming over Congress.

DeSantis tweeted on Sunday: “Our country is careening toward bankruptcy, and after this debt ceiling ‘deal’ it will still be careening toward bankruptcy. The deal green lights $4 trillion in new debt over the next year and a half, locks in inflated levels of spending from COVID, and keeps 98% of the Biden IRS expansion.”

His view is widely shared, including by this website. But his “National Spokesman” Steve Cortes disagrees, in a strange moment of internal division for the DeSantis team, and one that may deepen the turmoil in Tallahassee.

Cortes wrote: “Conservatives should welcome the deal that the GOP House negotiated against an obstinate Biden Administration… this agreement represents a worthy deal that should receive the support of patriotic populists.”

Cortes does accept there is more to be done, and did not sign the op-ed in his capacity as Never Back Down spokesman. The news comes as former Cruz strategist Jeff Roe removed long time DeSantis advisor Phil Cox from the campaign, after a horrific week for the campaign.

Those who may have expected the Durham Report to trigger criminal indictments against personnel in the Federal Bureau of Investigation who concocted the Crossfire Hurricane operation are likely to be disappointed.

"Was there adequate predication for the FBI to open the Crossfire Hurricane investigation on July 31, 2016 as a full counterintelligence and Foreign Agents Registration Act investigation given the requirements of The Attorney General's Guidelines for FBI Domestic Operations and FBI policies relating to the use of the least intrusive investigative tools necessary?".

What's Biden Doing With Migrants At The Ports Of Entry?

 As my colleague Todd Bensman and I have both recently explained, much of the focus on what a federal judge has referred to as the Biden administration's "Overarching non-detention policy" for migrants at the Southwest border has shifted to the ports of entry - where the president is attempting to funnel those migrants into the country and hide the resulting disaster from the public.

There are many misstatements of fact in that excerpt, beginning with the assertion that would-be illegal migrants could only schedule appointments for interviews at the border ports of entry once "Title 42 lifted" on May 11.

Returning to the January 5 White House press release and the May 16 CLAP rule, each contends that this funneling of migrants into the United States through the ports of entry is somehow a lawful course of entry.

How's Biden Releasing Thousands of Migrants Monthly at the Ports? Which brings me to the question of what the Biden administration is doing with those migrants who make appointments at the Southwest border ports of entry using the CBP One app.

Here is how the process works at the ports of entry: Any alien who seeks to enter the United States - legally or illegally, and at a port of entry or across the border between the ports - is defined in section 235(a)(1) of the INA as an "Applicant for admission".

CBP officers are not "Arresting" the inadmissible alien applicants they encounter at the ports of entry because they aren't free from restraint either at the ports or during the custody that - under section 235(b)(2)(A) of the INA - should occur thereafter.

What's Biden doing at the ports of entry with the migrants who have made interview appointments under his ludicrous CBP One scheme? I know that he is releasing nearly all of them, but regardless of whether he is releasing them en masse on parole or on their own recognizance, it's not legal.

The Struggle For Free Speech: More Reporting On Missouri V. Biden From Tracy Beanz

Major Charges Dropped Against Sai Kandula – The East Asian Migrant Terrorist with Nazi Flag Who Tried to Ram White House and Take Over the Country

Texas, Georgia, Arizona: Three cases studies of state oversight of troubled local elections

 Similar to Texas, Georgia has experienced issues with elections in Fulton County, which led the State Election Board to appoint a performance review board to conduct an assessment of the county.

After conducting a 17-month-long review, the board released its report this January, noting how, despite having issues in the 2020 presidential election, Fulton County has made improvements in the elections since and should continue to do so in preparation for the 2024 presidential election.

"Replacing the board would not be helpful and would in fact hinder the ongoing improvements to Fulton County elections." Georgia Secretary of State Brad Raffensperger has previously called for Fulton County's elections to be taken over by the state.

"With SB 202," the election integrity law passed in 2021, "Habitually failing counties can - actually the State Election Board can come in and replace the election director and really take over the governance of that," Raffensperger told the John Solomon Reports podcast in June 2021, noting Florida took similar action more than 10 years earlier and rectified problems in places like Palm Beach County.

Following the 2020 presidential election, the Arizona state Senate conducted an audit of the election in Maricopa County, which flagged a large number of voters who potentially voted in the county and at least one other county in the state.

While Arizona is currently run by a Democratic administration, following the 2020 election when Republicans still held the governor's and attorney general's offices, the state didn't take over administration of Maricopa County's elections.

Maricopa County, the largest county in the state, had election issues in 2022 while being run by Republican election officials.

Three Years Later, No Justice For BLM Insurrection In D.C.

 "The Tuesday night incidents that stretched over hours are the latest confrontations to transpire near the White House, where protesters have been gathering daily for more than a month to protest for racial justice after the killing of George Floyd in the custody of Minneapolis police," the Washington Post reported on July 8, 2020.

The] Treasury Annex building was vandalized; officers were assaulted with projectiles, such as bottles and bricks; and a brick struck a officer in the head, resulting in the officer's hospitalization.

USPP officers reported that some protesters threw projectiles, such as bricks, rocks, caustic liquids, frozen water bottles, glass bottles, lit flares, rental scooters, and fireworks, at law enforcement officials.

Overall, 49 USPP officers were injured during the protests from May 29 to May 31, including one who underwent surgery for his injuries.

On the evening of May 30, individuals at the protests threw projectiles at the officers and ultimately breached the first row of bike-rack fencing, thereby eliminating the buffer between the protesters and law enforcement officers.

Despite his claim his office is "Prosecuting a number of individuals in connection with the incidents of the summer of 2020," that simply does not appear to be the case, particularly since Graves further confirmed to Gosar that the office "Declined a number of arrests presented to it under the leadership of the prior administration."

Not only has Graves not charged any suspects involved in the 2020 riots under his watch, but his office also helped negotiate a settlement between the Justice Department and Lafayette Square rioters, who sued the government for violating their civil rights during what Graves called "Racial justice demonstrations in Lafayette Square." The settlement with Black Lives Matter D.C. required Park Police and Secret Service to update their policies to protect those who "Peacefully exercise their First Amendment rights."

A Covid Outbreak Happened At A CDC Conference With 99.4% Of Attendees "Vaccinated"

 Now, with Pandemic Panic Theater finally fading, a CDC conference with nearly 100% vaccination rate gets hit by a massive outbreak.

A COVID-19 outbreak unfolded at a conference held by the U.S. Centers for Disease Control and Prevention despite most attendees being vaccinated.

About 1,800 CDC staffers and others gathered in April in a hotel in Atlanta, where the CDC is headquartered, for a conference focused on epidemiological investigations and strategies.

The CDC and the Georgia Department of Public Health worked together to survey attendees to try to figure out how many people had tested positive.

Approximately 80 percent of attendees filled out the survey.

The CDC said the survey results "Underline the importance of vaccination for protecting individuals against severe illness and death related to COVID-19" because none of the people who said they tested positive reported going to a hospital.

About 8 percent of American adults are still unvaccinated, according to CDC data, though that percentage may be a big overestimate.

Transgender Surgery Offers NO Mental Health Boost, Study Confirms.

 Transgender surgery, also known as “gender-affirming surgery,” does not reduce the demand for mental health services, according to a study conducted by the American Journal of Psychiatry (AJP).

The study surveyed the effectiveness of gender-affirming hormone treatment and gender-affirming surgery on prescriptions for antidepressants and anti-anxiety medication, healthcare visits for mood and anxiety disorders, and post-suicide attempt hospitalizations among the Swedish population.

The study, following the AJP’s redaction, concluded that transgender surgery offers no improvement of one’s mental health and even suggested that there was “an increase in treatment for anxiety after surgery.”

The AJP was forced to make a major correction following the study’s initial conclusion that “surgery did reduce mental health treatment” after a number of clinicians questioned the study’s legitimacy, including Dr. Van Mol, Endocrinologist Michael Laidlaw, Child and Adolescent psychiatrist Miriam Grossman, and Paul McHugh, a distinguished university Service Professor of Psychiatry at Johns Hopkins Medical School.

Another Swedish study that the clinicians also highlight found that when assessing suicide over ten years after assignment surgery, “the sex-reassigned group had nineteen times the rate of completed suicides and nearly three times the rate of all-cause mortality and inpatient psychiatric care, compared to the general population.”

The news comes amidst reports of abuse of kids clinics in the United Kingdom pushing hormone therapy on children under 12.

It Would Appear Kevin McCarthy Somehow Did Worse Than Doing Nothing At All On The Debt Ceiling

 I am not entirely sure how it was possible, but it appears that Kevin McCarthy was able to find a deal that may be worse than a clean debt ceiling increase.

The text of the bill, which was released last night, confirms that spending is frozen at Fiscal Year 2022 levels, but there doesn't appear to be a dollar limit to the debt ceiling increase that comes along with that.

As it notes, this debt limit deal doesn't cut spending, it just limits how fast spending grows.

What's more, there are reports that every Democrat in the House - including the Progressive Caucus - is ready to vote for the deal, which should be a pretty clear sign McCarthy got rolled.

Others had similar complaints about the deal, including Senate Republicans.

A deal that increases the federal debt by $4 trillion isn't a deal at all.

Instead, what McCarthy brought back was a deal that makes the White House look good, and any opposition from the Republicans in the House ends up making them look worse.

Of Course: Gov. Hobbs Vetoes Election Integrity Reforms In Arizona

 Election irregularities have haunted Maricopa County, Ariz. for the past ten years, raising doubts about the legitimacy of a number of elections, including the 2020 presidential election, where Biden's state-certified victory was a tiny fraction of the overall vote, and again in 2022 in the election between Katie Hobbs and Kari Lake.

Republicans in Arizona - and other states with election issues - have sought to reform the state's elections to help ensure that everyone in the state can feel confident that results were conducted fairly.

Democrats have aggressively opposed the efforts and on Friday, Hobbs vetoed several bills from the GOP-controlled legislature - including four bills that would make elections more transparent.

Senate Bill 1105, which suggested permitting election personnel to tally early ballots at polling locations on Election Day, was likewise declined.

Hobbs's veto decisions come in the wake of Kari Lake's recent announcement that her organization, Save Arizona, plans to carry out the most extensive ballot-chasing endeavor in the state's history during the upcoming 2024 election cycle.

A struggle ensued between the Government and Plaintiffs, with the government fighting against the judge in this case to stop discovery and certain plaintiffs from being deposed.

At the appellate court level, the government argued really that NO ONE should have to leave their government jobs to sit for long depositions in this case, but certainly not the head of CISA, for example.

The appellate court wouldn't play ball with the government, and remanded the case back to Louisiana with some guidance on how the judge should proceed.

Then came the government's motion to dismiss, which the government had once withdrawn and then refilled.

Conservative House Republicans Threaten To Sink Biden, McCarthy Deal: 'We're Going To Try'

 Conservative House Republicans reacted angrily Sunday to the compromise agreed to between Speaker Kevin McCarthy and President Joe Biden to raise the debt ceiling.

The bill imposes some spending limits on discretionary non-defense spending and gave Republicans some of what they wanted on issues such as work requirements for some social services programs, according to The Hill.

"This is a good strong bill that a majority of Republicans will vote for. You're going to have Republicans and Democrats be able to move this to the president," McCarthy said, according to Reuters.

Multiple Republicans took to Twitter to lambaste the agreement.

Republican Rep. Chip Roy of Texas outlined his objections, in response to a plea to block the deal, told one Twitter poster, "We're going to try."

"I listened to Speaker McCarthy earlier tonight outline the deal with President Biden and I am appalled by the debt ceiling surrender. The bottom line is that the U.S. will have $35 trillion of debt in January, 2025. That is completely unacceptable," Rep. Ken Buck of Colorado posted on Twitter.

Yes: 38%. No: 62%. "Overwhelmingly, Republicans in this conference are going to support the deal. How could they not - it is a fantastic deal," he said.

The Biden Administration helped Hynansky's team in Ukraine prepare for the invasion, including placing calls to his top executive in Kiev 13 days in advance of Russian tanks crossing the border.

The president's close relationship with Hynansky illustrates larger ethical questions that have long surrounded Biden and his family members, who often have financial interests directly affected by policies he endorses.

In a speech in Kiev to government officials, Biden singled out Hynansky for praise, noting that he had just had breakfast with "My very good friend, John Hynansky."

Though Biden is silent about his actions in Ukraine as they concern Hynansky and his businesses there, he has repeatedly denied that his son's Burisma dealings influenced his official actions in Ukraine-which included handing over more than $50 million in U.S. support to assist the Ukrainian energy industry, an aid package Biden personally announced in Kiev the month before Burisma hired his son in 2014.

Soros Funded A Biden Center Report On Letting More Refugees Into The US

 Several authors of a Soros-funded Penn Biden Center report advocating for increasing the number of refugees allowed into the country now work in the Biden administration, handling immigration and national security policy.

The Penn Biden Center and the National Conference on Citizenship published a 2020 report, which was funded by a $259,050 grant from Open Society Foundations, recommending increasing the number of refugees permitted to come to the U.S. and easing restrictions on refugee eligibility, actions the White House has since taken.

Of the report's recommendations highlighting how the U.S. government should expand the refugee system, several proposals have been implemented during the authors' tenures in the Biden administration, including increasing cooperation with the United Nations to work with the U.S. to bring in more refugees, increasing the number of Latin American and Caribbean refugees and expanding refugee processing in the Western hemisphere.

The report recommended raising the refugee cap to 125,000, which President Joe Biden later did in fiscal years 2022 and 2023.

"The U.S. Refugee Admissions Program is at a crossroads. Under the Trump Administration, years of assault on the program have slashed admissions to historic lows, effectively eviscerating a bipartisan tradition of extending a lifeline to the world's most vulnerable people. If a new president is sworn into office in January 2021, he will likely arrive with a mandate to significantly increase refugee admissions levels," a summary of the report stated.

The Biden White House also raised the number of Latin American and Caribbean refugees the U.S. would accept to 15,000 in fiscal years 2022 and 2023.

"Under the Obama Administration, the average size of the LAC regional cap was roughly 4,400 with projected arrivals consistently falling significantly short. A new administration should significantly raise the regional LAC cap for admissions as an early demonstration of U.S. commitment to addressing the magnitude and severity of protection needs in the region, particularly in response to refugees fleeing the Northern Triangle countries and Venezuela," the report stated.
