On January 1, 2026, North Carolina implemented a law to officially recognize only two sexes—men and women. This legislation follows a veto override of Governor Josh Stein, a first-term Democrat.

• Definition of Sex: The law defines biological sex based on reproductive characteristics like sex chromosomes and genitalia at birth. It will not consider a person’s gender identity or personal experience.

• Legislative Background: The law was established on July 29, 2025, during a session where several other laws were enacted. North Carolina becomes the 18th state to adopt this binary definition of sex.

• Additional Legislation: Along with the sex recognition law, several other bills took effect:

• The Prevent Sexual Exploitation/Women and Minors Act: Addressing protective measures for women and children.

• The SCRIPT Act: Aims to increase transparency in prescription drug costs.

• The State Investment Modernization Act: Establishes a five-member authority to oversee retirement fund investments, transitioning from a sole fiduciary model.

• Other Bills: Other laws enacted include technical corrections to the budget, birth certificate reforms for adopted individuals, updates to business corporation statutes, and healthcare workforce reforms.

The new law in North Carolina significantly shapes the legal recognition of gender by limiting it to biological sex at birth. It coincides with the implementation of several other legislative measures aimed at various administrative functions in the state.
