President Donald Trump has reinstated single-sex prisons, which means that around 1,500 male federal prisoners who identify as women will be moved back to men's facilities. This decision follows an executive order titled "Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government. " The order also stops transgender-related medical procedures for inmates.
The Women's Liberation Front (WoLF), a feminist group that supports single-sex prisons, called this action a significant achievement. They are currently fighting against a California law that allows inmates to choose facilities based on their identity instead of their biological sex. WoLF claims this law infringes on the rights of incarcerated women as protected by the Eighth Amendment, which defends against cruel and unusual punishment. Trump's executive order reflects these concerns, stating that efforts to ignore biological sex threaten women's dignity, safety, and well-being.
On the other side, Shannon Minter from the National Center for Lesbian Rights, who supports housing transgender individuals in women's facilities, argues that this new policy could increase the risk of assaults on transgender inmates. He mentions that it complicates prison management and safety.
Recent reports highlight that a significant portion of male inmates identifying as female have been convicted of sexual offenses, with nearly 50% having such convictions compared to 11% of biological males. Among those wanting to transfer to women's prisons in California, about one-third are registered sex offenders, and they are linked to a high percentage of rapes in the prison system.
The practice of housing inmates based on gender identity began during the Obama administration but was reversed during Trump's first term to align housing with biological sex. The Biden administration later sought to restore the previous guidelines, which Trump has now again undone.
