Federal court strikes down warrantless FISA backdoor searches as unconstitutional

A federal judge has decided that the U. S. government’s use of "backdoor searches" without a warrant under Section 702 of the Foreign Intelligence Surveillance Act (FISA) is unconstitutional, marking a significant win for privacy advocates. The case focused on Agron Hasbajrami, whose communications were collected without a warrant while he was initially targeted for actions involving a foreign terrorist group. Judge LaShann DeArcy Hall ruled that warrantless searches of U. S. individuals' data violate the Fourth Amendment.

Section 702 was established to allow the government to collect data from non-U. S. persons abroad. However, it often captures communications from American citizens without their knowledge.
